Pacquiao sorry for confusion caused by Solar dispute

Filipino boxing champion Manny Pacquiao has apologized to his fans for any confusion that may have been caused by his decision to cut and then renew his ties with Solar Sports Entertainment.

This was after officials of Solar Sports Entertainment patched their differences with Pacquiao Friday (Saturday in Manila) over an apparent delay in payment of its financial obligations to Pacquiao

“Taos puso akong humihingi ng paumanhin kung kayo man ay naguluhan kung saan ipapalabas ang aking darating na laban kay Ricky Hatton. Ito po ay resulta lang ng hindi pagkaka-intindihan sa pagitan ng Solar Entertainment Corporation at MP Promotions,” Pacquiao said, in a statement read by his lawyer Franklin Gacal and aired over GMA-7.

Pacquiao said he decided to return to Solar after personally meeting with the company’s president Wilson Tieng and chief operating officer Peter Chanliong.

Valid contract

“Matapos ang masusing pag-aaral at pagtimbang-timbang namin ng Solar Entertainment Corporation, napatunayan na ang kontrata tungkol sa TV rights ng aking mga laban ay valid and binding at hindi nilabag nino man,” the statement read.

Pacquiao said he will now concentrate on his preparations for the May 2 superfight with Ricky Hatton.

“Simula sa araw na ito ay nais kong magconcentrate nang husto na lang sa aking training para sa aking darating na laban ngayong Mayo 2,” he said.

Solar Sports Entertainment earlier announced that Pacquiao had returned to its fold after a meeting between its executives and the boxer in Los Angeles.

“Solar Entertainment Corporation, Manny Pacquiao and MP Promotions, are happy to announce that in the spirit of utmost good faith, the parties have favorably resolved their unfortunate misunderstanding. Manny and MP Promotions have agreed to honor the television rights agreement and fully comply with the terms and conditions therein,” the company said.

Solar Sports Entertainment also said that Pacquiao’s fight with Hatton will be shown on GMA-7 and Solar Sports.

ABS-CBN's response

In response to this latest development, ABS-CBN Broadcasting Corp. said it has a signed contract with Pacquiao but that it would respect his decision if he changes his mind.

"Manny Pacquiao approached ABS-CBN to be his media partner in airing his next fights. We thank him for trusting us. He signed a contract with us, but we will not stand in the way if he decides to change his mind," ABS-CBN said. "We respect it, wish him good luck and we wait to hear from him."

Gacal, meanwhile, said that there is a possible meeting between Pacquiao and ABS-CBN Vice President for Sports Peter Musngi Saturday (Sunday in Manila).

"Sa ABS-CBN po, we would like to inform everybody that there is a possibility that Manny Pacquiao will be meeting Mr. Peter Musngi tomorrow," said Pacquiao's lawyer.

Pacquiao had rescinded his contract with Solar Sports Entertainment and chose ABS-CBN as the local broadcaster of his match against Hatton and other succeeding fights.

He claimed that Solar allegedly failed to settle its dues at the time specified in their contract.

Solar, however, claimed that the company has fulfilled all its financial obligations to Pacquiao.

Pacman blames ABS-CBN

MANILA, Philippines - Manny Pacquiao yesterday claimed that the news video aired by ABS-CBN, which showed him rescinding his contract with Solar Sports, was not supposed to have been shown at all.

Pacquiao said he did not want to go on air and announce that he has switched back to ABS-CBN until it was established that his contract with Solar, good from 2007 until 2011, had indeed been violated.

What’s quite ironic, if Pacquiao’s latest statement is true, was that he once again appeared over ABS-CBN last Friday, saying, “My decision is still the same. Watch my fight with Ricky Hatton on ABS-CBN.”

ABS-CBN later announced it wouldn’t make a statement, according to network executive Kane Choa. The other day, the station said it was letting go of Pacquiao.

“Is there anything new? I thought we’ve let go (of Pacquiao) as per yesterday’s statement. But from what I know it was Pacquiao who dictated the timing (of the news video),” said an ABS-CBN insider.

“Manny Pacquiao approached ABS-CBN to be his media partner in airing his next fights. We thank him for trusting us. He signed a contract with us, but we will not stand in the way if he decides to change his mind. We respect it (Pacquiao’s decision to honor the Solar contract), wish him good luck and we wait to hear from him,” said ABS-CBN in a statement the other day.

The video, shot in the balcony of Pacquiao’s LA apartment, was aired Wednesday evening over ABS-CBN, and triggered a very heated argument between ABS-CBN and Solar/GMA-7.

In that video, Pacquiao said Solar erred in delivering part of his payment for his May 2 fight with Ricky Hatton, so he decided to rescind the contract and switch back to ABS-CBN.

“After a thorough thinking, I have decided to approach ABS-CBN and I have decided to renew my partnership with them. This is my own decision,” said Pacquiao in the news video.

Sabi ko sa kanila huwag muna kami gumawa ng video pero sabi nila ‘gumawa na tayo pero itatago muna namin ( I told them let’s not make a video but they said we go ahead and keep it for the meantime),’” said Pacquiao without saying whom he was talking to on behalf of ABS-CBN.

Faced with a legal battle with Solar Sports and GMA-7, which may take years and cost him millions, Pacquiao recanted his statement last Saturday after he established that his contract was not violated.

“Everybody makes mistakes. Again, I apologize. What I learned from this is that I’m wiser now than yesterday,” said Pacquiao, drawing laughter from those listening to the phone-patch interview.

“Next time I will really think it over and not get carried away by emotions,” he said during a press conference at the Skyline Restaurant on the 17th floor of the GMA-7 Bldg. along Edsa.

He assured everyone that the incident won’t happen again.

In attendance were GMA-7 chairman and chief executive officer Atty. Felipe Gozon, chief operating officer Gilberto Duavit, Solar COO Peter Chanliong, and chairman William Tieng.

“It’s time to move forward. It’s all in our hopes that Manny Pacquiao triumphs in his coming fight,” Duavit said.

GMA Network also said it welcomed the decision of Pacquiao to retract his earlier announcement and honor his contract with Solar Sports.

GMA-7 joins UAAP TV war

GMA-7 yesterday joined the bidding war for the extensive broadcast rights of the UAAP games, officially making it a three-way race among rival ABS-CBN and Solar Sports for the right to air the country's most popular collegiate league.

UAAP president Anton Montinola of Season 72 host Far Eastern U announced that GMA-7 has presented its official bid in a meeting yesterday at the Quezon Hall of the University of the Philippines' Diliman, Quezon City campus.

"Yes, GMA has made its bid official, it's now a three-way race," Montinola told The STAR

ABS-CBN, which currently owns the rights to telecast all UAAP events until March 31, 2010, and Solar Entertainment have earlier submitted their respective bids.

In an effort to gain an edge over its rivals, ABS-CBN has offered to air the best-of-three UAAP seniors' championship on Channel 2 instead of airing it on its UHL channel Studio 23 as it used to in the last nine seasons.

Solar, for its part, will air it on CS9 and its cable channel BTV like it does with the PBA and the NBA games.

All three offer five-year bids.

UAAP ALSO ON SOLAR SPORTS? C'MON PLEASE SAY NOOOOOOOOOOOOOOO!

Solar Sports is pursuing its bid for the exclusive broadcast rights of the University Athletic Association of the Philippines notwithstanding the Manny Pacquiao brouhaha.

“Our UAAP bid is in,” Jude Turcuato, the Solar Sports marketing manager, told The STAR yesterday.

The statement came a few days after Pacquiao bolted out of Solar Sports, which has televised some of his past fights including his smashing victory over Oscar “The Golden Boy” dela Hoya last December.

The controversy somehow cast doubt on the capability and financial viability of Solar Sports in engaging television giants ABS-CBN and GMA in a bidding war for the right to air the UAAP events.

To date, ABS-CBN, through its UHF channel Studio 23, has been airing the UAAP games for the 10th season now. The existing contract between ABS-CBN and the UAAP expires on March 31, 2010.

“Whatever is the result of the Pacman issue, we stand by the UAAP bid. The Pacquiao issue should have nothing to do with it,” said Turcuato.

If it wins, Solar Sports would telecast games on CS9, its free channel partner, and its basketball and non-basketball cable channels BTV and Solar, respectively.

As for catering to the global market, Turcuato is offering a possible linkage with TFC (The Filipino Channel) and Pinoy TV as its international partners the same way it is doing with the Philippine Basketball Association.

“We don’t have an international channel so we will offer TFC and Pinoy TV if they (UAAP) want the PBA set-up,” Turcuato said.

TFC is owned by ABS-CBN while Pinoy TV is the new international channel of GMA.

To gain an edge, ABS-CBN earlier stated it would air the best-of-three UAAP seniors’ championship on Channel 2 instead of on Studio 23 as practiced in the past nine seasons.

GMA, which presented its official bid to the UAAP board Thursday, will televise it on affiliate channel QTV 11.

Pacquiao has no ABS-CBN contract

MANILA, Philippines - Even as Manny Pacquiao announced his decision to switch media loyalties to ABS-CBN, it appears the boxing icon has not signed a contract with the giant media network.

A reliable source said yesterday Pacquiao inked a letter of intent to move to ABS-CBN and a letter to rescind his contract with Solar Entertainment but had not signed anything to formalize an agreement with the Lopez group. This was confirmed by Pacquiao’s lawyer Franklin (Jeng) Gacal who flew from Manila to the US when he found out about the decision to terminate the Solar contract early this week.

Lawyer Enrique de la Cruz Jr. explained that in the absence of a signed contract with ABS-CBN, it will be easier to facilitate a settlement with Solar.

The speculation is Pacquiao shielded ABS-CBN by affirming it was his decision to move. If Pacquiao hasn’t signed a contract with ABS-CBN, it may also be a hedge as in the event he decides to go back to Solar, he wouldn’t be violating any contract with ABS-CBN.

De la Cruz said there is an apparent attempt to make it seem like ABS-CBN did not induce Pacquiao to switch.

As for Pacquiao’s letter to Solar requesting to inspect financial records in order to determine outstanding obligations, de la Cruz said it is a tacit admission that he has a live contract with the TV network.

“By asking to look into Solar’s financial records, Manny is invoking a provision in his contract with Solar which means he is admitting the contract is subsisting,” said de la Cruz. “It also means there is no basis for his decision to rescind because he is just now asking to look into the records.”

De la Cruz said Pacquiao must prove that Solar has been remiss in its obligations as a basis for rescission.

“Manny is challenging Solar’s contention that it has fulfilled all obligations and wants Solar to open its books for inspection,” said de la Cruz. “But isn’t that a little too late? Manny’s basis for rescinding is Solar hasn’t fulfilled its obligations. We’re ready to open Solar’s books but only in court. We’d like to see Manny’s basis for his claims of non-payment and we’ll show him our basis that Solar has not been remiss if we go to court.”

Based on Pacquiao’s video announcement of his decision to switch, ABS-CBN has started to air TV spots that “Pac Is Back.”

Regarding the deletions in the provisions of the Pacquiao contract provided by Solar to media during a press conference in Libis the other day, de la Cruz said it was no big deal and there was no cause to raise a howl.

“Firstly, the lawyers had nothing to do with distributing the copies,” said de la Cruz.

“What we learned was the Solar staff deleted the provisions which contained numbers, thinking they were confidential. They thought it would be prudent. But the contracts are public documents. When we saw the deleted portions, we immediately recopied the documents and distributed them to media with the deleted portions. There was no insidious attempt to hide anything. It was an honest mistake by the staff.

Before the conference was over, we made available copies of the contract with the complete provisions.”

De la Cruz said Pacquiao was misled into thinking he could wiggle out of the Solar contract which expires in 2011.

Pacquiao’s decision to move to ABS-CBN will trigger lawsuits from both Solar and its media partner GMA, which has an existing contract with the fighter as a talent now appearing in two network series.

Solar has the exclusive rights to air Pacquiao’s fights up to 2011 and for the Ricky Hatton bout on May 2, Solar signed a contract to air it on GMA.

Solar president Wilson Tieng and chief operating officer Peter Chanliong were locked in a meeting with Pacquiao in Los Angeles as The STAR went to press. The executives flew to the US last Friday night, hoping to iron out issues with Pacquiao.

De la Cruz, a partner with the PECABAR (Ponce-Enrile, Reyes and Manalastas) law office, said he handled a previous case involving ABS-CBN. He was the lawyer for Wins network that had the exclusive rights to air ABS-CBN shows on TFC in Japan. Wins went to court accusing ABS-CBN of distributing its shows to other media outlets in Japan, violating the terms of their contract. According to de la Cruz, ABS-CBN lost the case.
